ORDER NO. 189-1

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on November 16, 1965, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and appropriate waivers of service thereof as required by law, on the application of Jerry Ryan for an order granting an exception to Rule 316 of the Rules and Regulations of the Commission, for a well to be drilled in the SE¼SE¼SW¼ of Section 18, Township 1 South, Range 55 West Washington County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That an exception to Rule 316 of the Rules and Regulations of this Commission should be granted for a well to be drilled in the SE¼SE¼SW¼ of Section 18, Township 1 South, Range 55 West, 6th P.M., Washington County, Colorado, but in no event should such test well be located closer than 330 feet from the south line and 330 feet from the center line of said Section 18; and that said well should be the permitted well for the drilling unit upon which it is located; and that if a commercial well is drilled on the location set forth above instead of on a location as provided in said Rule 316, the Commission should, at the request of interested persons, take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the drilling of the well as an exception.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED that an exception shall be granted for a well to be drilled in the SE¼SE¼SW¼ of Section 18, Township 1 South, Range 55 West, 6th P.M., Washington County, Colorado, but that in no event shall such test well be located closer than 330 feet from the south line and 330 feet from the center line of said Section 18; and said well shall be the permitted well for the drilling unit upon which it is located; however, if a commercial well is drilled on the location set forth above instead of on a location as provided in Rule 316 of the Rules and Regulations of this Commission, the Commission shall, at the request of interested persons, take such action as will offset any advantage the person securing the exception may have over other producers by reason of the drilling of said well as an exception.
