CAUSE NO. 188

ORDER NO. 188-8

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on July 15, 1969, at 10 a.m., in Room 260, Columbine Building, Denver, Colorado, after publication of Notice of Hearing and receipt of appropriate waivers of service as required by law, on the application of J.M. Huber Corporation, in its behalf as Operator and on behalf of Continental Oil Company, Non-Operator, for an order granting an exception to the drilling and spacing units as established by Order No. 188-1.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That insufficient evidence was presented at the hearing to show that the drilling unit, the W½ NW¼ Section 15, Township 19 South, Range 45 West, 6th P.M., is located partly outside the field or that the requirement to drill the well at the authorized location on said drilling unit would be inequitable or unreasonable, therefore, the application should be denied.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the application for an exception to the drilling and spacing pattern as established by Order No. 188-1 for a well to be drilled 660 feet from the West line and 510 feet from the North line of Section 15, Township 19 South, Range 45 West, 6th P.M., Brandon Field, Kiowa County, Colorado, is hereby denied.

ORDERED this 22nd day of July 1969.
