REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on May 16, 1967 at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of hearing as required by law, on the Commission's own motion to consider measures to prevent the waste of oil in the Mississippian formation underlying certain lands in Kiowa County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction, to promulgate the hereinafter prescribed order.

 

3.      That geological testimony presented at the hearing indicates that the Mississippian formation underlying the Brandon Field is mainly a fractured carbonate reservoir and constitutes a common source of supply of oil underlain with water, with a minimal amount of gas.

 

4.      That engineering testimony presented at the hearing indicates that the main producing mechanism in said reservoir is an apparent water drive, and that excessive withdrawals of oil will tend to cause a reduction in the quantity of oil ultimately recoverable from the pool under prudent and proper operations.

 

5.      That in order to prevent excessive or disproportionate withdrawals from said reservoir, and to conserve the reservoir energy for the maximum ultimate recovery of oil, and to prevent waste, the Commission should, on a reasonable basis, limit such production from said Brandon Field,

 

6.      That further testimony presented at the hearing indicates that a production rate of One Hundred Fifty (150) barrels of oil per day per well from the Mississippian formation of the Brandon Field is a reasonable rate and will prevent waste, as defined by the oil and gas Conservation Act.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED that the following rules and regulations be, and the same are, hereby adopted for the Mississippian formation underlying the Brandon Field, Kiowa County, Colorado:

 

Rule 1.    During any one month, the maximum production of oil from the Mississippian formation underlying the Brandon Field shall be One Hundred Fifty (150) barrels per well per day.

 

Rule 2.    Under and over production of oil shall be adjusted on a monthly basis.  Underproduction of oil during any one month may be made up only during the month immediately following, and any overproduction of oil obtained during any one month shall be made up during the month immediately following.  Any overproduction of oil in excess of ten per cent (10%) of the total monthly allowable shall be considered a violation, unless a valid reason is given.  The production of oil in excess of twice the daily oil allowable during any one day shall be considered a violation.

 

Rule 3.    The operators and owners of wells producing from the Mississippian formation of the Brandon Field shall file with the Commission, on monthly production report forms required by this office, the production, by wells, of all oil, water, and gas, if any,

 

IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective June 1, 1967.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above rules and regulations.
