REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on July 21, 1980 at 9:00 a.m., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Petroleum, Inc. for approval of Well No. 2 Lincoln, NE¼SE¼ Section 10, Township 19 South, Range 45 West, 6th P.M., Brandon Field, Kiowa County, Colorado, as a water disposal well in the Mississippian.

FINDINGS

The Commission finds as follows:

1.      Petroleum, Inc., as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

4.      On June 3, 1980, Petroleum, Inc., filed an application pursuant to Rule 329 of the rules and regulations, for approval to use Well No. 2 Lincoln, located in the NE¼SE¼ Section 10, Township 19 South, Range 45 West, 6th P.M., Brandon Field, Kiowa County, Colorado, as a water disposal well in the Mississippian.  Protests to the granting of the application were filed with the Commission.

5.      Evidence presented at the hearing shows that injection of produced water into the Mississippian will have minimal effect on the reservoir, and such operation will not adversely affect the correlative rights of offset owners.  In addition, adequate protection has been taken to prevent contamination of the aquifers in the area. The application should therefore be approved.

ORDER

NOW, THEREFORE, IT IS ORDERED, that authority to dispose of produced water into the Mississippian, by use of Well No. 2 Lincoln, located in the NE¼SE¼ Section 10, Township 19 South, Range 45 West, 6th P.M., Brandon Field, Kiowa County, Colorado is hereby granted.
