CAUSE NO. 188

ORDER NO. 188-11

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on May 18, 1971, at 9 a.m., in Room 132, State Services Building, 1525 Sherman Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Inexco Oil Company, for an order granting an exception to the spacing pattern established by Order No. 188-1 for a well to be drilled 450 feet from the North line and 245 feet from the West line of the NEĽ NEĽ of Section 16, Township 19 South, Range 45 West, 6th P.M., Kiowa County, Colorado.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That on October 19, 1965, the Commission issued its Order No. 188-1 which, among other things, established 80-acre drilling units for the production of oil from the Mississippian formation, with the permitted well for each drilling unit to be located in the center of the NEĽ and SWĽ of each quarter section, with a tolerance of 150 feet in any direction.

4.      That a well has been drilled in the approximate center of the NEĽ NEĽ Section 16, Township 19 South, Range 45 West which has produced oil from the Mississippian formation and since the well is now producing water in such quantities as to be uneconomical, it will be necessary to plug and abandon said well, and that Applicant desires to drill a well to be located 450 feet from the North line and 245 feet from the West line of the NEĽ NEĽ Section 16, Township 19 South, Range 45 West as a substitute and such well will be the permitted well for the drilling unit upon which it is to be located, allowing the Applicant to recover additional oil that may otherwise be lost.

5.      That testimony presented indicates that said requested location is approximately 400 feet away from the original well in order to avoid water channeling and communication that may occur and in a direction as to maintain the same structural position.

6.      That no objection to the Applicant's request was presented.

ORDER

NOW, THEREFORE, IT IS ORDERED that an exception to the established spacing pattern for the Mississippian formation in the Brandon Field is hereby granted for a well to be located 450 feet from the North line and 245 feet from the West line of the NEĽ NEĽ, Section 16, Township 19 South, Range 45 West, 6th P.M., Kiowa County, Colorado, and such well shall be the permitted well for the drilling unit upon which it is located.

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective herewith.

ORDERED this 18th day of May 1971.
