REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on April 20, 1965, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of appropriate waivers of service thereof, all as required by law and the rules and regulations of the Commission, on the application of the Western Slope Gas Company for an order approving the storage of natural gas in underground reservoirs underlying the Asbury Creek Field, Mesa County, Colorado, which order would give Applicant an opportunity to pursue the right of condemnation for the acquisition of property, or any interests therein, for storage of natural gas in said reservoirs.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That Applicant, the Western Slope Gas Company, is a Colorado corporation, and is a natural gas public utility as required by the provisions of Chapter 100, Article 9, Colorado Revised Statutes 1953.

 

4.      That Applicant is in the business of transporting and distributing natural gas for ultimate public use and consumption in various Colorado communities and in various rural areas, and that all of such natural gas is subject to resale.

 

5.      That substantial evidence adduced by Applicant and introduced at the hearing shows that the proposed natural gas storage project defined in the following order is in the public interest and welfare, and that the storage reservoir is suitable and practicable; and that the formation sought to be condemned and which is the subject matter of the application is non-productive of oil or gas in commercial quantities under either primary or secondary recovery methods.

 

6.      That all interested parties present at the hearing were in accord with the use of said formation as a storage reservoir for natural gas.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED that the project as proposed by the Western Slope Gas Company for the storage of natural gas in an underground reservoir situated in the Dakota formation within the following described area in the Asbury Creek Field, Mesa County, Colorado, is hereby approved:
