ORDER NO. 180-2

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on November 18, 1975 at 9 a.m., in Room 532, State Services Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Tri-State Oil & Gas, Inc. for an order to amend Order No. 180-1 to add additional lands to the spaced area and to re-align a certain drilling and spacing unit.  The Commission, on its own motion, considered further amending of the order to delete certain lands and re-align other units in the spaced area.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place, and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on August 18, 1964, the Commission issued its Order No. 180-1 which established fourteen (14) designated 160-acre drilling and spacing units for the production of gas and associated hydrocarbons from the "J" Sand underlying the Kiowa Creek Field, Weld County, Colorado.

 

4.      That geological evidence presented at the hearing indicates that the "J" Sand underlying the W½SW¼ Section 32, Township 2 North, Range 61 West, 6th P.M. is a common source of supply of gas and associated hydrocarbons with that of the Kiowa Creek Field and that said lands should be included in the spaced area and the designated unit which consists of the E½SW¼ and the W½SE¼ should be re-aligned to consist of the SW¼ of said Section 32.

 

5.      That evidence presented indicates that the W½ Section 33, Township 2 North, Range 61 West, 6th P.M. should be deleted from the spaced area and that the designated units, one of which consists of the E½SE¼ Section 32, and the W½SW¼ Section 33, and the other consisting of the E½SW¼ and the W½SE¼ Section 33, Township 2 North, Range 61 West, 6th P.M. should be re-aligned to consist of the SE¼ of said Section 32 and the SW¼ of said Section 33.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that Order No. 180-1 for the Kiowa Creek Field, Weld County, Colorado, is hereby amended and the W½SW¼ Section 32, Township 2 North, Range 61 West, 6th P.M., shall be included in the spaced area and said lands shall be made subject to the provisions of Order No. 180-1; and the W½SE¼ Section 33, Township 2 North, Range 61 West, 6th P.M., shall be deleted from the spaced area and operation in said lands shall be governed by the general rules and regulations of the Commission.

 

IT IS FURTHER ORDERED, that the 160-acre designated drilling and spacing units, as described in Findings 4 and 5 herein, shall be re-aligned to consist of the SW¼ Section 32, Township 2 North, Range 61 West; the SE¼ Section 32, Township 2 North, Range 61 West, and the SW¼ Section 33, Township 2 North, Range 61 West, 6th P.M.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
