ORDER NO. 171-4

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on March 15, 1982 in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing, as required by law on the application of Michigan Wisconsin Pipe Line Company, for an order extending the spaced area of the Walsh Field as established by Order No. 171-1, and extended by Order No. 171-2.  The application was amended at the hearing to consider a well to be drilled 660 feet from the west line and 1320 feet from the south line in Section 12, Township 33 South, Range 43 West to be the permitted well for the unit.

 

FINDINGS

 

The Commission finds as follows:

 

1.      Michigan Wisconsin Pipe Line Company, as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On March 19, 1963, the Commission issued Order No. 171-1 which established 640-acre drilling and spacing units for the production of gas from the Virgilian Series (Pennsylvanian), common source of supply underlying lands in the Walsh Field.  The permitted well is at a location no closer than 1320 feet from the outer boundaries of the unit.  The spaced area was extended by Order No. 171-2.

 

5.      Testimony presented at the hearing indicates a common source of supply of gas from the Virgilian Series (Pennsylvanian) underlies, in addition to the area set forth in Order No. 171-1 and 171-2, the following described lands in Baca County, Colorado, to-wit:

 

Township 33 South, Range 43 West, 6th P.M.

Section 10: All

Section 12: All

Section 11: All

 

 

and that such area should be included in the spaced area of the Walsh Field and made subject to the provisions of Order No. 171-1.  However, Well No. 1-10 Griffin, located in the SW¼SW¼ Section 10, and Well No. 1-11 Griffin, located in the SE¼SW¼ Section 11, and a well to be drilled 660 feet from the west line and 1320 feet from the south line, Section 12 should be considered the permitted wells for the units upon which each is located.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the area as set forth in Finding 5 herein shall be included in the spaced area of the Walsh Field, Baca County, Colorado, and shall be subject to the provisions of Order No. 171-1 and the Walsh Field shall henceforth include the following described lands in Baca County, Colorado, to-wit:

 

Township 31 South, Range 43 West, 6th P.M.

Section 33:  All

 

 

Township 32 South, Range 43 West, 6th P.M.

 

Sections  2 thru 4

 

Sections  9 thru 17

 

Sections 20 thru 29

IT IS FURTHER ORDERED that Well No. 1-10 Griffin located in the SW¼SW¼ Section 10 and Well No. 1-11 Griffin located in the SE¼SW¼ Section 11 and a well to be drilled 660 feet from the west line and 1320 feet from the south line, Section 12 shall be considered the permitted wells for the units upon which each is located.

 

IT IS FURTHER ORDERED that the provisions contained in the above orders shall become effective forthwith.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its rights after notice and hearing to alter amend or repeal any and/or all of the above orders.
