ORDER NO. 168-3

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on July 16, 1974 at 9 a.m., in Room 132 State Services Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the Commission's own motion to consider the rescinding, of Order No. 168-1 for the Bijou-South Field.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on May 22, 1962, the Commission issued its Order No. 168-1 which established 320-acre drilling and spacing units for the production of gas from the "D" Sand underlying the following described lands in the Bijou-South Field, Morgan County, Colorado, to-wit:

4.      That subsequent Order No. 168-2 established 320-acre drilling and spacing units for the production of gas and associated hydrocarbons from the "J" Sand underlying certain other lands in the Bijou-South Field than described above, but including Section 28.

 

5.      Since all wells in the spaced area, as described in Finding 3 herein, are now plugged and abandoned, and in order to promote future development, Order No. 168-1 is no longer necessary and should be vacated and the area governed by the general rules and regulations of the Commission, except for said Section 28 which should remain subject to the provisions of Order No. 168-2.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that Order No. 168-1 in Cause No. 168 for the Bijou-South Field, is hereby rescinded, and operations in the area as described in Finding 3 herein shall be governed by the general rules and regulations of the Commission except for Section 28, Township 4 North, Range 59 West, 6th P.M., which shall remain subject to the provisions of Order No. 168-2.
