REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on May 16, 1983 and continued to June 27, 1983 at 9:00 a.m., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Coors Energy Company for an order approving the use of Well No. 1-26 Meador, located in the NE1/4 Section 26, Township 10 South, Range 97 West, 6th P.M., Plateau Field, Mesa County, as a water disposal well into the Rollins, Cozzette and Corcoran formations.

 

FINDINGS

 

The Commission finds as follows:

 

1.      Coors Energy Company, as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      Protests to the granting of the application were received.

 

5.      Evidence presented at the hearing indicates that the location of the proposed water disposal well is in the immediate vicinity of a dwelling and domestic water well, and that there are other well sites in the area that could be available for water disposal purposes with less potential to ground water pollution, accidental spills and environmental problems; therefore, the application to use Well No. 1-26 Meador, located in the NE1/4 Section 26, Township 10 South, Range 97 West, 6th P.M., as a water disposal well should be denied.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the application of Coors Energy Company requested approval to use Well No. 1-26 Meador, located in the NE1/4 Section 26, Township 10 South, Range 97 West, 6th P.M., Plateau Field, Mesa County, Colorado as a water disposal well into the Rollins, Cozzette and Corcoran formations is hereby denied.
