ORDER NO. 156-7

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on April 16, 1963, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of appropriate waivers of service thereof, on the application of Texaco, Inc. for an order granting an exception to the permitted well location designated by Order No. 156-1 for a well to be drilled 2250 feet from the north line and 900 feet from the west line of Section 22, Township 35 North, Range 20 West, N.M.P.M., Montezuma County, Colorado, to test the Ismay zone of the Hermosa formation. The exception is requested because of surface conditions.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on October 3, 1961, the Commission issued its Order No. 156-1 which, among other things, established a drilling unit comprised of Lots 5 and 6, Section 22, Township 35 North, Range 20 West, N.M.P.M., Montezuma County, Colorado, with the permitted well location designated as the center of said drilling unit, with a tolerance of 150 feet in any direction for surface conditions.

 

4.      That evidence presented indicates that the approved location for the above described drilling unit is inaccessible for the drilling of a well; and that therefore, an exception to the permitted well location should be granted for a well to be drilled 2250 feet from the north line and 900 feet from the west line of said Section 22, in order to test the Ismay zone of the Hermosa formation.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that an exception is hereby granted for a well to be drilled 2250 feet from the north line and 900 feet from the west line of Section 22, Township 35 North, Range 20 West, N.M.P.M., Montezuma County, Colorado, and said well shall be the permitted well for the drilling unit upon which it is located.
