REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on August 18, 1970, at 10 a.m., in the P.U.C. Hearing Room, 5th Floor, Columbine Building, 1845 Sherman Street, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of Tesoro Petroleum Corporation, for an order amending Rule 1 of Order No. 144-1 deleting certain lands overlying the Mesaverde and Frontier formations and further to amend Rule 2 of said Order and establish for the remaining lands one designated drilling and spacing unit for production of gas from the Frontier formation and four designated drilling and spacing units for production of gas from the Mesaverde formation.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That evidence presented at the hearing indicates that the Mesaverde and Frontier formations, common sources of supply of gas underlying the area as defined in Rule 1 of Order No. 144-1, do not coincide and that said Rule should be amended to delete the following described lands overlying the Mesaverde formation in the Big Gulch Field, Moffat County, Colorado:

4.      That in order to prevent the waste of gas, as defined by law; to protect the correlative rights of all parties concerned; to prevent the drilling of unnecessary wells, and to insure proper and efficient development and promote conservation of the gas resources of the State, Rule 2 of Order No. 144-1 should also be amended and establish for the remaining lands one 640-acre designated drilling and spacing unit for the production of gas from the Frontier formation and four designated drilling and spacing units of approximately 480 acres each for production of gas from the Mesaverde formation, with a permitted well for each said unit.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that Rules 1 and 2 of Order No. 144-1 are hereby amended and the lands as described in Finding 3 are hereby deleted from the Big Gulch Field; and for the remaining lands, the following spacing and drilling units shall be, and the same are hereby established for the production of gas from the Mesaverde and Frontier formations:

IT IS FURTHER ORDERED, that the order contained herein shall become effective forthwith.

 

IT IS FURTHER ORDERED that the Commission expressly reserves its right, after notice and healing, to alter, amend or repeal any and/or all of the above orders, rules and regulations.
