REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on October 16, 1978 at 9 a.m., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Northwest Exploration Company for an order deleting certain lands from the spaced area of the Rulison Field, Garfield County, Colorado.  The application was amended at the hearing to not include the NW¼ Section 26, Township 6 South, Range 94 West in the area requested to be deleted.

 

FINDINGS

 

The Commission finds as follows:

 

1.      Northwest Exploration Company, as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On December 10, 1959, the Commission issued Order No. 139-1 which established 640-acre drilling and spacing units for the production of gas from the Mesaverde formation underlying certain lands in Garfield County, Colorado.  By Order No. 139-2, the Commission extended the spaced area and included the Wasatch formation.  Further extension or the spaced area was established by Order No. 139-3.

 

5.      Evidence presented at the hearing indicates that 640-acre drilling and spacing units for the production of gas from the Mesaverde and the Wasatch formations were established pending further evidence to be obtained from operators in the field to consider proper spacing.  Since that time no commercial production has been obtained in the area requested to be deleted.  Therefore, in order to promote future development in the area, the following described lands should be deleted and said area governed by the general rules and regulations of the Commission:

NOW, THEREFORE, IT IS ORDERED, that the lands as described in Finding 5 herein, are hereby deleted from the spaced area of the Rulison Field and are no longer subject to the provisions of the orders in Cause No. 139, and shall be governed by general rules and regulations of the Commission.  The lands remaining in the Rulison Field, Garfield County, Colorado, and subject to the provisions of the orders in Cause No. 139 are described as follows:

CORRECTION OF ORDER OF THE COMMISSION

 

TO ALL INTERESTED PERSONS AND TO WHOM IT MAY CONCERN:

 

Order No. 139-7, issued October 16, 1978 for the Rulison Field, Garfield County, Colorado, is hereby corrected to include the following described lands remaining in the Rulison Field subject to the provisions of Order Nos. 139-1, 139-2 and 139-3:
