ORDER NO. 139-20

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on December 17, 1990 at 8:30 a.m. in Room 101, State Education Building, 201 East Colfax, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Barrett Energy Company for an order vacating Order 139-12 which allowed a well to be drilled at an exception location in the SE1/4 of Section 27, Township 6 South, Range 94 West, 6th P.M., Garfield County, for the production of gas and associated hydrocarbons from the Mesaverde formation, and granting an exception to the permitted well locations as provided for in Order No. 139-2 and allow a well to be drilled 690 feet FNL and 2275 FEL in the NW1/4 NE1/4 of Section 27, for the unit consisting of the E1/2 of said Section 27, in Township 6 South, Range 94 West, 6th P.M., Garfield County, Colorado, for production from the Mesaverde formation underlying these lands.

 

FINDINGS

The Commission finds as follows:

 

1.      Barrett Energy Company as applicant herein is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said notice and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On December 10, 1959, the Commission authorized Order No. 139-1 to be issued, which among other things, established 640-acre drilling and spacing units for the production of gas from the Mesaverde formation underlying certain lands in Garfield County, Colorado.  On March 21, 1960, the Commission issued Order No. 139-2 which amended Order No. 139-1 to include more lands and on July 16, 1979, the Commission issued Order 139-8 which established 320-acre drilling and spacing units for some of the lands contained in the Rulison Field, with the drilling units consisting of a governmental section with the permitted well to be located in the NE1/4 and SW1/4 of each section and no closer than 990 feet to the boundaries of the quarter section upon which it is located.

 

5.      On May 15, 1989, the Commission authorized Order 139-12 to be issued which allowed a well to be drilled at an exception location in the center of the SE1/4 of Section 27, Township 6 South, Range 94 West, 6th P.M. for production from the Mesaverde for the unit consisting of the E1/2 of said Section 27.  This well will not be drilled.

 

6.      The matter was heard by the Hearing Officer who recommends approval based upon the topographic testimony presented at an administrative hearing.

 

7.      No objections to the application were received and an order of the Commission should be entered allowing a well to be drilled at the above described exception location.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that Order 139-12 which allowed a well to be drilled at an exception location in the SE1/4 of Section 27, Township 6 South, Range 94 West, 6th P.M., Garfield County, for the production of gas and associated hydrocarbons from the Mesaverde formation is hereby vacated.

 

IT IS FURTHER ORDERED, that an exception to the permitted well location as provided for in Order No. 139-8 for the Rulison Field is hereby granted for a well to be drilled 690 feet FNL and 2275 FEL in the NW1/4 NE1/4 of Section 27, Township 6 South, Range 94 West, 6th P.M. for production from the Mesaverde formation for the unit consisting of said Section 27.

 

IT IS FURTHER ORDERED, that the provisions in the above order shall become effective forthwith.
