CAUSE NO. 136

ORDER NO. 136-2

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on December 10, 1959, at 10 a.m., in the Spruce Room of the Albany Hotel, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of Byron H. Lord for an order granting permission to commingle oil and gas producible from the "D" and "J" sand formations underlying his Monaghan No. 1 well located in the NW¼ NW¼ of Section 8, Township 3 South, Range 65 West, 6th P.M., Adams County, Colorado, and prescribing such conditions as to the method of producing such well and the commingling of production therefrom as may appear to be necessary or desirable in the public interest and to protect the interest of all parties affected thereby.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That Applicant is the owner of an oil and gas lease which covers, among other lands, the NW¼ NW¼ of Section 8, Township 3 South, Range 65 West, 6th P.M., Adams County, Colorado, and that the Monaghan No. 1 well is located in said forty-acre tract.

4.      That said well is now producing from the "D" sand formation through casing perforations at a depth of 8312 feet to 8321 feet; and that said well is capable of producing from the "J" sand formation through casing perforations at a depth of approximately 8361 feet to 8367 feet and that Applicant should be permitted to perforate said "J" sand formation at a depth of approximately 8376 feet to 8386 feet, and that said well should be allowed to produce from both the "J" sand formation and the "D" sand formation; and that the quantity of production from any one formation will not justify single zone completions.

5.      That all available geological, and engineering data concerning said well indicate that the multiple zone completion and the commingling of the production in the well bore will not result in waste, and that no damage will result to any formation because of said multiple zone completion or commingling.

ORDER

NOW, THEREFORE, IT IS ORDERED that the following rules and regulations shall apply hereafter to the Monaghan No. 1 well located in the Northwest Quarter of the Northwest Quarter (NW¼NW¼) of Section Eight (8), Township Three (3) South, Range Sixty-five (65) West of the 6th P.M., Adams County, Colorado, in addition to other applicable rules and regulations and orders of this Commission, if any, heretofore adopted and not in conflict herewith:

Rule 1.    Authority is hereby granted Byron H. Lord for multiple zone completion of his Monaghan No, 1 well by perforating the casing opposite the "J" sand formation at depths of approximately Eight Thousand Three Hundred Sixty-one feet to Eight Thousand Three Hundred Sixty-seven feet (8361' - 8367') and approximately Eight Thousand Three Hundred Seventy-six feet to Eight Thousand Three Hundred Eighty-six feet (8376' - 8386'); and producing from the "D" sand formation through casing perforations at a depth of Eight Thousand Three Hundred Twelve feet to Eight Thousand Three Hundred Twenty-one feet (8312' - 8321'), and commingling the production from the two formations in the well bore.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend, or repeal any and/or all of the above order.

ORDERED this 10th day of December 1959.
