REPORT OF THE COMMISSION

 

            This cause came on for hearing before the Commission on November 25, 1997 at 8:30 a.m., in Suite 801, The Chancery Building, 1120 Lincoln Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the verified application of Marathon Oil Company for an order to establish an approximate 640-acre drilling and spacing unit for the production of gas and associated hydrocarbons from the Entrada and/or Nugget Formation comprised of Lot 4, Section 17, and Lots 5 through 12, Section 18, Township 12 North, Range 100 West, 6th P.M., Moffat County, Colorado.  Other additional lands contained in the proposed 640 acre unit lie within lands in the Hiawatha Field located in Sweetwater County, Wyoming.

 

FINDINGS

 

                        The Commission finds as follows:

 

                        1.  Marathon Oil Company, as applicant herein, is an interested party in the subject matter of the above‑referenced matter.

 

                        2.  Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

                        3.  That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

                        4.  That evidence and testimony presented at the administrative hearing indicates that the Entrada and Nugget Formations are a common source of supply under Sections 17 and 18, Township 12 North, Range 100 West, 6th P.M.

 

                        5.  That a fault exists through the Entrada and Nugget Formations on the northwest side of the spacing unit and the spacing unit boundary was chosen to coincide with this fault.  The best possibility for production from the Entrada and Nugget Formation is from portions of the reservoir near the fault.

 

                        6.  That State of Wyoming has approved the portion of the spacing unit located in Sweetwater County, Wyoming, by letter dated November 18, 1997.

 

                        7.  At the time of the administrative hearing, the Applicant agreed to be bound by oral order of the Commission.

 

            8.  Based on the facts stated in the application, having received no protests and having been heard by the Hearing Officer who recommends approval of the application, the Commission should approve the request and establish an approximate 640-acre drilling and spacing unit for the production of gas and associated hydrocarbons from the Entrada and/or Nugget Formation comprised of Lot 4, Section 17, and Lots 5 through 12, Section 18, Township 12 North, Range 100 West, 6th P.M., Moffat County, Colorado.  Other additional lands contained in the proposed 641 acre unit lie within lands in the Hiawatha Field located in Sweetwater County, Wyoming.

 

ORDER

 

                        NOW, THEREFORE, IT IS ORDERED, that an approximate 640-acre drilling and spacing unit is hereby established for the production of gas and associated hydrocarbons from the Entrada and/or Nugget Formation comprised of Lot 4, Section 17, and Lots 5 through 12, Section 18, Township 12 North, Range 100 West, 6th P.M., Moffat County, Colorado.  Other additional lands contained in the approximate 640-acre unit lie within lands in the Hiawatha Field located in Sweetwater County, Wyoming.

 

                        IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective forthwith.

 

                        IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders, rules and regulations.
