ORDER NO. 127-1

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on May 26, 1959, at 10 a.m., in the Game Room of the Albany Hotel, Denver, Colorado, after publication of Notice of Hearing, as required by law, on the Commission's own motion to consider measures to prevent waste of oil and gas in the "J" sand formation of the Luster Field, Morgan County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That the "J" sand formation constitutes common sources of supply of oil and gas underlying the following described lands in Morgan County, Colorado, to-wit:

 

Township 1 North, Range 55 West, 6th P.M.

Section 34:

 

and that such area is referred to as the Luster Field.

 

4.      That all operators in the Luster Field have jointly undertaken an engineering study to determine the maximum efficient producing rate for the field; and that detailed results of such study should be submitted to the Commission within a reasonable time as an aid for further action.

 

5.      That subject field should be produced in such a manner as will best furnish information necessary to complete the engineering study referred to in Finding 4 hereof; provided, however, that such production practices are conducted in a non-wasteful manner.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the following rules and regulations shall apply hereafter to a well drilled, completed, or recompleted in the "J" sand formation underlying the Luster Field, herein defined, in addition to other applicable rules and regulations and orders of the Commission, if any, heretofore adopted and not in conflict herewith:

 

Rule 1.    The Luster Field, Morgan County, Colorado, shall include the following described lands, to-wit:

 

South Half (S½) of Section Twenty-seven (27), East Half (E½) of Section Thirty-three (33), and West Half (W½) of Section Thirty-four (34), Township One (1) North, Range Fifty-five (55) West of the 6th P.M.

 

Rule 2.    Detailed results of the engineering study referred to in Finding 4 hereof shall be submitted to the Commission within a reasonable time.

 

Rule 3.    The Luster Field shall be produced in such a manner as will best furnish information necessary to complete said engineering study; provided, however, that such production practices are conducted in a non-wasteful manner.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above rules and regulations.
