ORDER NO. 118-4

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on October 18, 1982 at 9:00 a.m., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing, as required by law, on the application of TXO Production Corporation, for an order rescinding Order No. 118-3 for the Little Hoot Field, and make the lands described therein subject to the general rules and regulations of the Commission, or in the alternative, that an exception to Order No. 118-3 be granted and a 160-acre drilling and spacing unit be established consisting of the NW1/4 Section 12, Township 10 North, Range 54 West, 6th P.M., and a well be allowed to be drilled thereon for the production of gas from the "D" and "J" Sands.

 

FINDINGS

 

The Commission finds as follows:

 

1.      TXO Production Corporation, as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On June 18, 1974, the Commission issued Order No. 118-3 which amended Order No. 118-1 and reduced the spacing and established 320-acre drilling and spacing units for the production of gas from the "D" and "J" Sands underlying certain lands in the Little Hoot Field, Logan County, Colorado.

 

5.      Evidence presented at the hearing indicates that the provisions of Order No. 118-3 are no longer necessary and in order to promote future development in the area, Order No. 118-3 should be rescinded; however, Section 1, Township 10 North, Range 54 West, 6th P.M., which has a producing well, should remain subject to the provisions of said Order and the following described lands should be deleted from the spaced area of the Little Hoot Field as established by Order No. 118-3.

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the lands described in Finding 5 herein are hereby deleted from the Little Hoot Field, as defined by Order No. 118-3 and the lands in the Little Hoot Field subject to the provisions of Order No. 118-3 shall henceforth consist of the following described lands:

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above order.
