ORDER NO. 112-9

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on February 21, 1961, at 10:00 a.m., in Room 227, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service, as required by law, on the application of Irving Pasternak, doing business as Shar-Alan Oil Company, for an exception to Order No. 112-6, for a well drilled 990 feet north of the south line and 990 feet east of the west line of Section 15, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado; and that all of said Section 15 be designated as the drilling unit for production of gas from the Dakota formation.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That all of Section 15, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, should be designated as the drilling unit for production of gas from the Dakota formation.

 

4.      That an exception to Order No. 112-6 should be allowed for a well drilled 990 feet from the south line and 990 feet from the west line of said Section 15, and that said well should be the permitted well for the drilling and spacing unit upon which it is located.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that Section 15, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, shall be the designated drilling unit for the production of gas from the Dakota formation; and an exception to Order No. 112-6 is hereby granted for a well drilled 990 feet from the south line and 990 feet from the west line of said Section 15, and said well shall be the permitted well for the drilling and spacing unit upon which it is located.
