ORDER NO. 112-88

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on February 19, 1991 at 2:00 p.m. in Room 101, State Education Building, 201 East Colfax Avenue, Denver, Colorado, after giving Notice of Hearing as required by law, on the Commission's own motion to consider recommendations, information and data submitted to establish such other field rules as may be deemed necessary for the efficient and economical development of the Ignacio Blanco Field.

 

FINDINGS

 

The Commission finds as follows:

 

1.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      The Commission recognizes the interests of the Southern Ute Indian Tribe and of the Federal Government in this matter, has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order affecting all lands other than those owned by Indians.

 

3.      The Commission accepted recommendations from the staff and testimony from operators and the public on the issue of establishing an area-wide water testing program from which a public database would be developed to monitor and protect the health, safety and welfare of the citizens in the Ignacio Blanco field area.

 

4.      The Commission should establish a task group composed of a representative from the Colorado Oil and Gas Conservation Commission (OGCC), La Plata County, Colorado Department of Health (Water Quality Control Division), Division of Water Resources, two members representing local citizens, and two members from industry.  This group should prepare a written report to be submitted to the Commission at the March 19, 1991 Commission hearing with the final report to be submitted at the April 16, 1991 Commission hearing.

 

5.      The Commission should recommend to the Southern Ute Indian Tribe that they cooperate to the maximum extent possible to allow the Task Force meet their goals.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that a task group consisting of a representative from the Colorado Oil and Gas Conservation Commission (OGCC), La Plata County, Colorado Department of Health (Water Quality Control Division), Division of Water Resources, two members representing local citizens, and two members from industry shall be formed.  This group should prepare a written report to be submitted to the Commission at the March 19, 1991 Commission hearing with the final report to be submitted at the April 16, 1991 Commission hearing.

 

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its rights, after giving notice and hearing, to alter, amend or repeal any and/or all of the above orders.
