REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on January 10, 1961, at 10-00 A.M., in Room 720, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service, as required by law, on the application of Irving Pasternak, doing business as Shar-Alan Oil Company, for an exception to Order No. 112-6, for a well to be drilled 990 feet from the south line and 990 feet from the west line of Section 15, Township 33 North, Range 7 West of the N.M.P.M., La Plata County, Colorado; and that all of Section 15 be designated as the drilling unit for production from the Dakota Sandstone formation; and that the W½ of Section 15 be designated as the drilling unit for production from the Mesaverde formation.  At the hearing, Applicant amended the above application to cover the Mesaverde formation, only.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That the W½ of Section 15, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, should be designated as the drilling unit for production of gas from the Mesaverde formation.

4.      That an exception to Order No. 112-6 should be allowed for a well to be drilled 990 feet from the south line and 990 feet from the west line of said Section 15, and that said well should be the permitted well for the drilling and spacing unit upon which it is located.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the W½ of Section 15, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, shall be the designated drilling unit for the production of gas from the Mesaverde formation; and an exception to Order No. 112-6 is hereby granted for a well to be drilled 990 feet from the south line and 990 feet from the west line of said Section 15, and said well shall be the permitted well for the drilling and spacing unit upon which it is located.

ORDERED this 10th day of January 1961.
