ORDER NO. 112-19

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on January 15, 1963, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and receipt of Waivers of Service as required by law and the rules and regulations of the Commission, on the application of Tex-Star Oil & Gas Corp. for an order authorizing, as an exception to the spacing pattern established by Order No. 112-6, the location of a well to be drilled 990 feet from the north and east lines of Section 35, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, for production of gas from the Mesaverde formation; and designating the N½ of said Section 35 as the drilling unit for the Mesaverde formation.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That testimony presented indicates that a well located 990 feet from the north and east lines of Section 35, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, would be more productive than a well located in conformance with the spacing pattern established by Order No. 112-6; and that the N½ of said Section 35 should be designated as the drilling unit for production of gas from the Mesaverde formation.

 

4.      That no objections to Applicant's request were presented.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the N½ of Section 35, Township 33 North, Range 7 West, N.M.P.M., La Plata County, Colorado, shall be the designated drilling unit for production of gas from the Mesaverde formation; and an exception to the spacing pattern established by Order No. 112-6, insofar as it pertains to production of gas from the Mesaverde formation, is hereby allowed for a well to be drilled 990 feet from the north and east lines of said Section 35; and said well shall be the permitted well for the drilling unit upon which it is located.
