ORDER NO. 109-2

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on April 22, 1958, at 10:00 A.M., in the Auditorium of the Petroleum Club Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of the Skelly Oil Company for an order granting permission and authority to drill a well in the NW NE NE of Section 16, Township 8 South, Range 102 West of the 6th P.M., and extending the Garmesa Area to include the W NW of Section 15, Township 8 South, Range 102 West of the 6th P.M., Garfield County, Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3. That on October 15, 1957, the Commission issued Order No. 109-1 which defined the Garmesa Area and specified that the drilling of additional wells within the Garmesa Area shall not be allowed without notice and hearing.

 

4. That evidence presented at the hearing indicates that the limits of the Garmesa Area should be extended to include the W NW of Section 15, Township 8 South, Range 102 West of the 6th P.M., Garfield County, Colorado.

 

5. That in order to protect the correlative rights of all parties, and to allow each owner and producer an opportunity to produce his just and equitable share of the gas underlying the Garmesa Area, permission should be granted to drill a well in the Center of the NW NE NE of Section 16, Township 8 South, Range 102 West of the 6th P.M., Garfield County, Colorado.

 

6. That the officer of the United States having jurisdiction over the Federal lands involved has given his approval to the drilling of said well and the extension of said area.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the following rules and regulations shall apply hereafter to the Garmesa Area herein described, in addition to other applicable rules and regulations and orders of the Commission, if any, heretofore adopted and not in conflict herewith:

 

Rule 1. The Garmesa Area shall be extended to include, in addition to the area as set forth in Order No. 109-1, the West Half of the Northwest Quarter (W NW) of Section Fifteen (15), Township Eight (8) South, Range One Hundred Two (102) West of the 6th P.M., Garfield County, Colorado, and shall hereafter be defined as follows:

 

Southwest Quarter (SW) of Section Thirty-one (31), Township Seven (7) South, Range One Hundred Two (102) West, 6th P.M.; Southeast Quarter (SE) of Section Thirty-five (35), and the South Half of the North Half, and South Half (S N, S) of Section Thirty-six (36), Township Seven (7) South, Range One Hundred Three (103) West, 6th P.M.; Southwest Quarter (SW) of Section Four (4), all of Sections Five (5) and Six (6), the North Half and Southeast Quarter (N, SE) of Section Seven (7); all of Sections Eight (8) and Nine (9); West Half of the Northwest Quarter (W NW) of Section Fifteen (15); North Half (N) of Section Sixteen (16), and Northeast Quarter (NE) of Section Seventeen (17), Township Eight (8) South, Range One Hundred Two (102) West, 6th P.M.; and all of Section One (1), Township Eight (8) South, Range One Hundred Three (103) West, 6th P.M., all in Mesa and Garfield Counties, Colorado.

 

Rule 2. Permission is hereby granted for a well to be drilled in the Center of the Northwest Quarter of the Northeast Quarter of the Northeast Quarter (NW NE NE) of Section Sixteen (16), Township Eight (8) South, Range One Hundred Two (102) West of the 6th P.M., Garfield County, Colorado.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right after notice and hearing, to alter, amend or repeal any and/or all of the above rules and regulations.
