ORDER NO. 109-1

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on October 15, 1957, at 10 a.m., in Room 243 State Capitol, Denver, Colorado, after publication of Notice of Hearing as required by law, on the Commission's own motion requesting all operators, owners and producers in subject area to be present at the hearing and submit to the Commission all well and reservoir data available, and make recommendations as to the establishment of field rules, especially as they might pertain to production limitations and the establishment of drilling units.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That the Garmesa Area should be defined as follows:

 

Township 7 South, Range 102 West, 6th P.M.

Section 31:  SW/4

Section 36:  S/2 N/2, S/2

all in Mesa and Garfield Counties, Colorado.

 

4.      That the evidence presented at the above hearing was insufficient, at this time, to establish field rules and spacing units; however, in the opinion of the Commission, in order to prevent waste as defined in the Oil and Gas Conservation Act, and to prevent the drilling of unnecessary wells, the drilling of additional wells within the Garmesa Area should not be allowed without notice and hearing.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the following rules and regulations shall apply hereafter to the Garmesa Area herein described, in addition to other applicable rules and regulations and orders of the Commission, if any, heretofore adopted and not in conflict herewith:

 

Rule 1.    The Garmesa Area shall be defined as follows:

 

Southwest Quarter (SW/4) of Section Thirty-one (31), Township Seven (7) South, Range One Hundred Two (102) West, 6th P.M.; Southeast Quarter (SE/4) of Section Thirty-five (35), and the South Half of the North Half, and the South Half (S/2 N/2, S/2) of Section Thirty-six (36), Township Seven (7) South, Range One Hundred Three (103) West, 6th P.M.; Southwest Quarter (SW/4) of Section Four (4), all of Sections Five (5) and Six (6), the North Half and Southeast Quarter (N/2, SE/4) of Section Seven (7); all of Sections Eight (8) and Nine (9); North Half (N/2) of Section Sixteen (16), and Northeast Quarter (NE/4) of Section Seventeen (17), Township Eight (8) South, Range One Hundred Two (102) West, 6th P.M., and all of Section One (1), Township Eight (8) South, Range One Hundred Three (103) West, 6th P.M., all in Mesa and Garfield Counties, Colorado.

 

Rule 2.    The drilling of additional wells within the Garmesa Area shall not be allowed without notice and hearing.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above rules and regulations.
