REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on January 20, 1970, at 10 a.m., in Conference Room 260, Columbine Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Cabot Corporation, which application was amended to delete Section 29, for an order extending the boundaries of the McClave Field, and establishing a drilling and spacing unit of approximately 640 acres for the production of gas from the McClave sand formation.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That the McClave Sand constitutes a common source of supply of gas underlying, in addition to the area set forth in Order No. [sic] 105-4, and 105-7, the following described lands in Kiowa County, Colorado, to-wit:

Township 19 South, Range 48 West, 6th P.M.

Section 28:  All

and that such area should be subject to the provisions of Order Nos. 105-1 and 105-2.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the following rules and regulations shall apply hereafter to a well drilled, completed or recompleted in the McClave Sand underlying the McClave Field, herein defined, in addition to other applicable rules and regulations and orders of the Commission, if any, heretofore adopted and not in conflict herewith.

Rule 1.    The McClave Field shall henceforth include the following described lands in Bent and Kiowa Counties, Colorado, to-wit:

Township 19 South, Range 48 West, 6th P.M.

Kiowa County, Colorado

Sections 28, 31, 32, 33, 34, 35 and 36

Township 20 South, Range 48 West, 6th P.M.

Kiowa County, Colorado

Sections:  All

Township 19 South, Range 49 West, 6th P.M.

Kiowa County, Colorado

Sections 35 and 36

Township 20 South, Range 49 West, 6th P.M.

Kiowa County, Colorado

Sections   1, 2, 3, 10, 11, 12, 13, 14, 23, 24, 25, 26, 35 and 36

Township 21 South, Range 48 West, 6th P.M.

Bent County, Colorado

Sections 1, 2, 3, 4, 5, 6, 8 and 9

Rule 2.    The following drilling and spacing unit consisting of approximately 640 acres is hereby established for the production of gas from the McClave Sand, common source of supply underlying the lands set forth in Finding 3 hereof:

Township 19 South, Range 48 West, 6th P.M.

Section 28:  All

and the permitted well for said unit shall be located within a radius of 990 feet from the center thereof.

IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective forthwith, and henceforth the commencement of the drilling of any well or wells in the McClave Sand, common source of supply in the McClave Field, as defined herein, for the purpose of producing gas therefrom at a location other than authorized by this order is hereby prohibited.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend, or repeal any and/or all of the above orders, rules and regulations.
