Order No. 105-2

REPORT OF THE COMMISSION

            This cause came on for hearing before the Commission on April 26, 1960, at 10:00 A.M., in the Game Room of the Albany Hotel, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of the Frankfort Oil Company, a Division of Joseph E. Seagram and Sons, Inc., for an order extending the area of the McClave Field, the additional area to be spaced the same as set forth in Order No. 105-1 issued May 15, 1957, and otherwise subject to the provisions of Order No. 105-1.

FINDINGS

            The Commission finds as follows:

            1. That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

            2. That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

            3. That the McClave Sand constitutes a common source of supply of gas underlying, in addition to the area set forth in Order No. 105-1, the following described lands in Kiowa County, Colorado, to-wit:

                    Township 19 South, Range 48 West, 6th P.M. Sections 31, 35 and 36

                    Township 19 South, Range 49 West, 6th P.M. Sections 35 and 36

                    Township 20 South, Range 49 West, 6th P.M. Sections 12, 26, 35 and 36

                    Township 20 South, Range 48 West, 6th P.M. Sections 1, 2, 11, 12, 13, 14, 23, 24, 25, 26, 31 and 36 and that such area should be subject to the provisions of Order No. 105-1.

            4. That Rule 1(a) of Order No. 105-1 should be amended to read as follows: "That the permitted gas well for each 640-acre drilling and spacing unit shall be located within a radius of 990 feet from the center of the drilling and spacing unit upon which it is located; provided, however, that the Commission may grant exceptions to this rule because of topographical reasons.

ORDER

            NOW, THEREFORE, IT IS ORDERED, that the following rules and regulations shall apply hereafter to a well drilled, completed or recompleted in the McClave Sand underlying the McClave Field, heroin defined, in addition to other applicable rules and regulations and orders of the Commission, if any, heretofore adopted and not in conflict herewith:

Rule 1. The McClave Field shall henceforth include the following described lands in Bent and Kiowa Counties, Colorado, to-wit:

            Rule 2. Rule l(a) of Order No. 105-1 is hereby amended to read as follows: "That the permitted gas well for each 640-acre drilling and spacing unit shall be located within a radius of 990 feet from the center of the drilling and spacing unit up-on which it is located; provided, however, that the Commission may grant exceptions to this rule because of topographical reasons."

            IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective forthwith.

            IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing: to alter, amend or repeal any and/or all of the above rules and regulations.
