ORDER NO. 10-6

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on March 20, 1978 at 9 a.m.., in Room 110; State Centennial Building, Denver, Colorado, after giving Notice of Hearing, as required by law, on the Commission's own motion, to consider the approval to use Well No. 7 Gillette, Keota Field, Weld County, Colorado, as a water disposal well.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That on November 21, 1977 the Commission issued its Order No. 10-5 which, among other things, ordered Pepper Tank Company to make application for the disposal of produced water from the Keota Field pursuant to Rule 329, Underground Disposal of Water.

 

4.      That an application to use Well No. 7 Gillette, NW¼ SW¼ Section 4, Township 9 North, Range 61 West, 6th P.M. as a water disposal well was filed with the Commission on January 19, 1978. A protest to the granting of the application was filed on January 27, 1978 by Charles A. Underwood.

 

5.      That a review of said application indicates that it is not in compliance with some provisions of Rule 329, Underground Disposal of Water, of the rules and regulations of the Commission, and should be dismissed without prejudice and may be refiled [sic].     

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED that the application filed January 19, 1978 by Pepper Tank Company for approval to use Well No. 7 Gillette, located in the NW¼ SW¼ Section 4, Township 9 North, Range 61 West, 6th P.M. Keota Field, Weld County, Colorado, as a water disposal well is hereby dismissed without prejudice.
