REPORT OF THE COMMISSION

 

                        This cause came on for hearing before the Commission at 8:30 a.m. on December 2, 1999 in Suite 801, The Chancery Building, 1120 Lincoln Street, Denver, Colorado, on the Commission Motion to amend Order No. 1V-176 to allow Marilyn Messer to sign a guarantee of performance in accordance with §34-60-106 (13)(a) C.R.S. as financial assurance for the domestic gas well located in the S½ of Section 33, Township 19 South, Range 69 West, 6th P.M.

 

FINDINGS

 

                        The Commission finds as follows:

 

                        1.  Marilyn Messer is an interested party in the subject matter of the above-referenced hearing.

 

                        2.  Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

                        3.  The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

                        4.  On August 19, 1999, the Commission issued Order No. 1V-176 which, among other things, allowed Marilyn Messer to provide a lien agreement as financial assurance for a domestic gas well in a form and priority acceptable to the Commission in accordance with §34-60-106 (13)(f).

 

                        5.  While preparing the documents for a lien on Ms. Messer’s property, Assistant Attorney General Enger recommended the original order be amended to allow Ms. Messer to sign a guarantee of performance in accordance with §34-60-106 (13)(a) C.R.S. as financial assurance for the domestic gas well, rather than incurring the expenses to prepare a lien agreement.

 

                        6.  Ms. Messer has provided the Commission with a financial statement of her net worth.

 

                        7. Assistant Attorney General Enger has prepared a guarantee of performance for Ms. Messer’s signature.

 

                        8. At the time of the administrative hearing, after discussion and revision, Ms. Messer agreed to execute the guarantee of performance.

 

                        9. Ms. Messer duly executed the Guarantee of Performance and Waiver of Liability on November 30, 1999.

 

                        10. Based on the facts stated in the application and the testimony and exhibits presented at the time of the administrative hearing by Ms. Messer, the Commission should amend Order No. 1V-176 to allow Ms. Messer to sign a guarantee of performance in accordance with §34-60-106 (13)(a) C.R.S. as financial assurance for the domestic gas well.

 

                                                                                    ORDER

 

                        NOW, THEREFORE, IT IS ORDERED that Order No. 1V-176 is hereby amended to allow Ms. Messer to sign a guarantee of performance in accordance with § 34-60-106 (13)(a) C.R.S. as financial assurance for the domestic gas well located in the S½ of Section 33, Township 19 South, Range 69 West, 6th P.M.

 

                        IT IS FURTHER ORDERED that the provisions contained in the above order shall be come effective forthwith.

 

                        IT IS FURTHER ORDERED that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
