ORDER NO. 1-59

REPORT OF THE COMMISSION

 

                        This cause came on for hearing before the Commission on October 17, 1995 at 8:30 a.m. in Suite 801, the Chancery Building, 1120 Lincoln Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of William R. Stoddard for an order for a reduction from the bonding requirements as provided for in Rule 304 of the Rules and Regulations of the Oil and Gas Conservation Commission for the Zahm No. 29-3 Well located in the NEĽ NEĽ of Section 29, Township 10 South, Range 96 West, 6th P.M.

 

FINDINGS

The Commission finds as follows:

 

1.    William R. Stoddard, as applicant herein, is an interested party in the

subject matter of the above‑referenced hearing.

 

                        2.  Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

                        3. The Commission has jurisdiction over the subject matter embraced in said notice and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

                        4.  That Mr. Stoddard owns the surface land on which the Zahm No. 29-3 Well is located in the NEĽ NEĽ of Section 29, Township 10 South, Range 96 West, 6th P.M., and intends to obtain the well for use as a domestic gas well.

 

            5.  That calculations made by the Commission engineering staff show that

actual costs to and abandon the Zahm No. 29-3 Well would require a bond of five thousand ($5,000) dollars to be posted by Mr. Stoddard. 

 

            6.  That at the September hearing, the Commission recommended Mr.

Stoddard provide staff with calculations to justify costs provided verbally by Mr. Stoddard and continued the matter to the October hearing.  The requested information was not received by the Commission from Mr.Stoddard prior to the October hearing, nor was Mr. Stoddard present at the October hearing.

 

            7.  That the Commission should deny the application for a reduced bond

and Mr. Stoddard should post a five thousand ($5,000) dollar bond with the Commission.

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the application of William R. Stoddard for an order for a reduction from the bonding requirements as provided for in Rule 304 of the Rules and Regulations of the Oil and Gas Conservation Commission for the Zahm No. 29-3 Well located in the NEĽ NEĽ of Section 29, Township 10 South, Range 96 West, 6th P.M. is hereby denied.

 

                        IT IS FURTHER ORDERED, that Mr. Stoddard shall post a five thousand ($5,000) dollar bond with the Commission and submit a Certificate of Clearance and/or Change of Operator, Form 10, for operation of the Zahm No. 29-3 Well.

 

                        IT IS FURTHER ORDERED, that the provisions in the above order shall become effective forthwith.
