                                                             REPORT OF THE COMMISSION

 

                        This cause came on for hearing before the Commission on October 18, 1993 at 8:30 a.m. in Room 318, State Centennial Building, 1313 Sherman Street, Denver, Colorado, after giving Notice of Hearing as required by law, on the application of Jack L. Warr for an order for a reduction from the bonding requirements as provided for in Rule 304 of the Rules and Regulations of the Oil and Gas Conservation Commission for the Jacobs No. 2 Well located in the NE1/4 NW1/4 SW1/4 of Section 1, Township 1 North, Range 97 West, 6th P.M. Rio Blanco County, Colorado.

 

                                                                                 FINDINGS

 

                        The Commission finds as follows:

 

                        1.  Jack L. Warr, as applicant herein is an interested party in the subject matter of the above‑referenced hearing.

 

                        2.  Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

                        3.  The Commission has jurisdiction over the subject matter embraced in said notice and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

                        4.  That Mr. Warr who owns the surface land on which the Jacobs No. 2 Well located in the NE1/4 NW1/4 SW1/4 of Section 1, Township 1 North, Range 97 West, 6th P.M. Rio Blanco County, Colorado is located, intends to purchase the well for use as a domestic gas well to provide fuel to an irrigation pump for farming.  The pits have been closed and the wellsite cleared by Zier & Company, the previous owner of the well.

 

                        5.  That calculations made by the Commission engineering staff show that costs to plug and abandon the Jacobs No. 2 Well would require that a bond of five thousand ($5000) dollars should be posted by Mr. Warr. 

 

                        6.  That the Commission staff's calculation for an approved procedure and cost estimates to plug and abandon the Jacobs No. 2 Well was sent to Mr. Warr for review and no response was received by the Commission from Mr. Warr. 

 

                        7.  That the Commission should deny the application for a reduced bond and Mr. Warr should post a five thousand ($5000) dollar bond with the Commission, along with a Certificate of Clearance/Change of Operator, Form 10, as the new operator for the Jacobs No. 2 Well.

 

                                                                                 O R D E R

 

                        NOW, THEREFORE, IT IS ORDERED, that the application of Jack Warr for an order for a reduction from the bonding requirements as provided for in Rule 304 of the Rules and Regulations of the Oil and Gas Conservation Commission for the Jacobs No. 2 Well located in the NE1/4 NW1/4 SW1/4 of Section 1, Township 1 North, Range 97 West, 6th P.M. Rio Blanco County, Colorado is hereby denied.

 


                        IT IS FURTHER ORDERED, that Mr. Warr shall post a five thousand ($5000) dollar bond with the Commission, along with a Certificate of Clearance/Change of Operator, Form 10, as the new operator for the Jacobs No. 2 Well.

 

                        IT IS FURTHER ORDERED, that the provisions in the above order shall become effective forthwith.
