REPORT OF THE COMMISSION

 

            On August 1, 2012, Petron Development Company, on behalf of its clients Warren Resources #1 LLC and Walker Energy LLC (collectively, "Petron") petitioned the Commission ("Application") to sanction Augustus Energy Partners LLC ("Augustus") for violation of Rule 318(B) and the Payment of Proceeds Act, C.R.S. §34-60-118.5(5), with respect to the Day 32-23 Well (API No. 05-125-10723) ("Well"), Buffalo Grass Field, Yuma County, Colorado.

 

            On November 5, 2012, Applicant and Augustus reached a settlement of the matter.  Accordingly, Petron withdrew its Application and requested dismissal of its petition against Augustus, with prejudice.

 

            IT IS THEREFORE ORDERED, that the captioned matter is dismissed with prejudice as to any and all claims asserted, or that may be asserted, by Petron with respect to Augustus' ownership and operation of the Well.

 

            IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective immediately.

 

            IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.

 

            IT IS FURTHER ORDERED, that under the State Administrative Procedure Act the Commission considers this Order to be final agency action for purposes of judicial review within 30 days after the date this Order is mailed by the Commission.

 

            IT IS FURTHER ORDERED, that an application for reconsideration by the Commission of this Order is not required prior to the filing for judicial review.
