Description: Complainant is concerned about drilling waste being dumped on a property located approximately 2-miles north of Hwy 14 on the west side of CR95. Does not believe the waste is being managed properly, also concerned about the amount of truck traffic, dust and possible impact on surrounding property values.
Resolution: NOAV #200328837 was issued to Continental Resources for E&P Waste Rule violations. Corrective actions require compliance with Rule 907.d.(3)B regarding land application of bentonitic drilling fluids. Also required to perform sampling analysis to verify compliance with Table 910-1 standards. Continental submitted a Form 27 on 12/2/11 with sampling analysis plan. Form 27 was approved on same date. Sample results are pending.

James with integrity trucking sent email with copy of surface owner authorization to apply bentonitic fluids as beneficial soil amendment. Also received a call from Mr. Crouse (co-complainant Ref #200328829). Mr. Crouse said that a representative of Integrity Trucking had talked to him. He said they had delivered equipment to location and were spreading and incorporating the material that had been applied to date. He thanked COGCC for the quick response to address his concerns.

Informed Cody that E&P waste being dumped on property off CR95 (Reference Weld County Parcel #054314100005) is not being managed properly. Discussed problems and suggested they discontinue using location until material could be properly managed. Cody said he would contact supervisor responsible for that location to follow up.

Spoke with Mr. Mireles regarding E&P waste violations for application of bentonitic fluids at CR95 location. He believed there was an agreement in place with the landowner. I suggested they discontinue using location until waste could be managed properly. Mr. Mireles said he would contact site personnel to get specific information to follow up. I notified him there would be an NOAV issued due to the violations observed and associated complaints.

Through County records determined that the property is owned by Eloy Carreon & Rosa Perez 3734 Settler Ridge Dr, Mead, CO 80542. No phone number listed for either party. Visited location again and collected representative sample of solids. Appeared to be bentonitic fluids with cuttings and exhibited hydrocarbon odor. During visit trucks began dumping at location again. Interviewed Mr. Enrique Lozano owner of Lozano Trucking 720-205-4687. Mr. Lozano said that GRL Welding hired him to transport the material. He said it was coming from a location off CR 79 & 84. He did not know what the material was, who the oil & gas operator was or who the property owner was. Also interviewed a driver, Mike, with Integrity Trucking. He did have specific information regarding generator = Continental Resources Hahn #1-4H and verified the same location as Mr. Lozano. He provided contact with Integrity as Cody @ 970-397-3907. During visit observed Lozano with two dump trucks dumping mostly solids. Integrity using vac trucks dumping liquids. Some E&P waste being tracked onto CR95. Still no equipment on site to properly manage waste.

Visited location where drilling fluids and cuttings are being dumped. Site is currently grass with no agricultural activity. There is a topographic low area immediately north/northwest of placement area where it appears surface water accumulates intermittently. There are no stormwater controls in place. Solids are being dumped in piles 2-3 feet high. Some material is being tracked onto the county road. There have been approximately 150 loads dumped on location with no equipment on site to manage material. Did not observe any trucks during visit. Will try to find property owner and operator generating fluids.
