Description: THREE YEARS AGO, MR. HARTRONFT PURCHASED THE 4.8 ACRE PIECE OF PROPERTY IN BOULDER COUNTY WITH AN EXISTING GAS WELL, TANK, AND SEPARATOR. MR HARTRONFT RECEIVED A LETTER DATED JANUARY 29, 2007 FROM ENCANA THAT THEY WOULD BE DRILLING A NEW WELL NEXT TO THE EXISTING WELL. SINCE HE AND HIS WIFE WERE OUT OF TOWN AT THE TIME, THEY PICKED UP THE CERTIFIED LETTER FROM THE POST OFFICE ON THEIR RETURN. IN TALKING WITH ENCANA`S CONTRACT LAND MAN, PETER SCOTT, HE ASKED THE WELL BE MOVED FURTHER SOUTH. INITIALLY SCOTT REPLIED THAT IT WOULD BE TOO CLOSE TO THE BOULDER COUNTY OPEN SPACE PROPERTY LINE, HOWEVER, SCOTT WAS SUBSEQUENTLY ABLE TO OBTAIN A WAIVER. ON MARCH 9, MR. HARTRONFT MET WITH SHIELA FRAZIER OF ENCANA AND PETER SCOTT. MR. HARTRONFT AND FRAZIER WENT THROUGH THE WHOLE LIST OF THINGS HE AND SCOTT HAD INFORMALLY TALKED ABOUT. FRAZIER SAID SHE WOULD SEND HIM AN AUTOCAD DRAWING SHOWING THE PROPOSED WELLL SITE LAYOUT AND A DRAFT SUA. HE FEELS THE 306 CONSULTATION WAS THIS MEETING ON MARCH 9. WHEN HE HAD NOT HEARD FROM ENCANA ON MARCH 19 AND HE WAS CONCERNED ABOUT THE 10 BUSINESS DAY WINDOW FOR THE ONSITE INSPECTION REQUEST CLOSING, HE SENT AN EMAIL TO ALEX FISCHER REQUESTING AN ONSITE INSPECTION. SHORTLY THEREAFTER, HE LOOKED ON THE COGCC WEBSITE AND FOUND OUT THAT THE PERMIT HAD ALREADY BEEN APPROVED. HE FEELS HE WAS NOT CONSULTED WITH IN GOOD FAITH AND THAT THE RULE 306 CONSULTATION DATE OF 1/29/07 LISTED ON THE APD IS FALSE BECAUSE HE AND HIS WIFE WERE NOT EVEN IN TOWN ON THAT DATE.

Mr. Hartronft did receive an SUA; however, it did not reflect all of the issues as discussed with Encana. Mr. Hartronft elected not to pursue the issue further. Encana did drill the well and Mr. Hartronft has some potential issues with site restoration and reclamation. He will visit the well site and report any issues to COGCC. These issues will be filed under a separate complaint.

VIA EMAIL, OFFERED TO CONSULT WITH MR. HARTRONFT AT THE WELL LOCATION. HE REPLIED THAT HE WOULD REVIEW THE DRAFT SUA BEFORE MAKING ANY DECISIONS.

DISCUSSED CONSULTATION INFORMATION FROM ENCANA. SUGGESTED THAT HIS OPPORTUNITY FOR COMMENT WAS LIKELY SATISFIED BY THE 2/19/07 LETTER HE SENT TO ENCANA. HE RESPONDED THAT AL LHE HAD GOTTEN FROM P. SCOTT WAS A GERNERAL VERBAL DESCRIPTION OF WHERE THEWELL AND TANK BATTERY WOULD BE. HE THEN TOOK IT UPON HIMSELF TO GET A SURVEY AND PLACED ON THE PLAT WHERE HE WOULD LIKE THINGS TO GO. HE DOES NOT FEEL ENCANA HAS BEEN ADEQUATE IN THEIR RESPONSES OR IN THEIR GOOD FAITH CONSULTATION REQUIREMENTS, NOR WAS HE ADEQUATELY INFORMED OF THE ONSITE INSPECTION POLICY.

INQUIRED OF FRAZIER THE TIMING OF CONTACTS BETWEEN ENCANA AND HARTRONFT. 30 DAY NOTICE LETTER SENT ON 11/13/06. THERE WERE SUBSEQUENT DISCUSSIONS BACK AND FORTH BETWEEN HARTRONFT AND PETER SCOTT BETWEEN THAT DATE AND 1/17/07 WHEN THEY RECEIVED THE LOCATION WAIVER LETTER FROM BOULDER COUNTY. ON 2/19/07 ENCANA RECEIVED FROM HARTRONFT AN EMAIL ATTACHEMENT SHOWING A SURVEY OF HIS PROPERTY AND THE PREFERRED LOCATIONS OF ACCESS ROADS AND OTHER FACILITIES. HARTRONFT ALSO SENT OVER A DRAFT SUA. FRAZIER IS MAKING CHANGES TO SUA AND TO THE SURVEY PLOT SO THAT IT WILL MEET RULES AND BE ACCEPTABLE TO ENCANA LEGAL DEPARTMENT. SEVERAL COMMUNICATIONS BETWEEN HARTRONFT AND SCOTT OCCURED AFTER THE 2/19/07 CORRESPONDENCE. MEETINGS WITH HARTRONFT TOOK PLACE ON 3/2/07 AT 3 P.M. AND AGAIN ON 3/9/07. FRAZIER CONFIRMED THAT THE 306 DATE ON THE APD REFLECTED THE RE-NOTICE DATE OF 1/29/07. SHE WILL WORK WITH PERMITTING FOLKS TO ENSURE FUTURE APDS ERFLECT ACTUAL 306 CONSULTATION DATE.
