REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on December 19, 1958, at 10 a.m., in Room 243, State Capitol, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of Clyde G. Kissinger for an exception to Order No. 116-3, for a well to be drilled in the center of the NW¼ SE¼ SW¼ of Section 2, Township 4 North, Range 60 West, 6th P.M.; and on the Commission's own motion to consider testimony relating to the redefining of the limits of the Orchard Field, Cause No. 90, and the Bijou Area, Cause No. 116; and to consider other related matters concerning drilling and spacing units within the above areas; and to consider or the inclusion of all or portions or the E½ NW¼ of Section 11, Township 4 North, Range 60 West, 6th P.M., Morgan County, Colorado in either the Orchard Field or the Bijou Area.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required, by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That on May 15, 1956, the Commission issued its Order No. 90-1 in Cause No. 90, Orchard Field, establishing 40-acre drilling and spacing units for the production of oil and gas in the "D" and "J" sands, common sources of supply, and defining the area to be known as the Orchard Field; and that on January 28, 1958, Order No. 90-3 was issued which order deleted certain portions of said Orchard Field.

4.      That subsequent development reveals that the E½ SW¼ of Section 2, Township 4 North, Range 60 West, 6th P.M., deleted from the Bijou Area by Order No. 116-4, should be returned to the Orchard Field; and that the E½ NW¼ of Section 11, Township 4 North, Range 60 West, 6th P.M., deleted from the Orchard Field by Order No. 90-3, issued January 28, 1958, should also be returned to the Orchard Field.

5.      That the requested exception to the spacing pattern for a well to be drilled in the center of the NW¼ SE¼ SW¼ of Section 2, Township 4 North, Range 60 West, 6th P.M., is unnecessary because said location coincides with the prescribed location for a well in that portion of the Orchard Field.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the area set forth in Finding 4 hereof shall be included in the Orchard Field and shall be subject to the provisions of Order No. 90-1, Cause No. 90, and the Orchard Field shall henceforth include the following described lands in Morgan County, Colorado, to-wit:

West Half of the West Half (W½ W½) and East Half of the Southwest Quarter (E½ SW¼) of Section Two (2); all of Sections Three (3), Four (4), Nine (9), and Ten (10), and Northwest Quarter (NW¼) of Section Eleven (11), Township Four (4) North, Range Sixty (60) West, 6th P.M., Morgan County, Colorado.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above order.
