IN THE MATTER OF THE PROMULGATION AND ESTABLISHMENT OF FIELD RULES TO GOVERN OPERATIONS IN THE "D" AND "J" SANDS OF THE ORCHARD FIELD, MORGAN COUNTY, COLORADO	) ) ) )	CAUSE NO. 90 ORDER NO. 90-4    (Emergency)

REPORT OF THE COMMISSION

The Oil and Gas Conservation Commission of the State of Colorado has heretofore established forty-acre drilling and spacing units, with the permitted well in the center of a prescribed unit, for the "D" and "J" sands of the Orchard Field, Morgan County, Colorado, by its Order No. 90-1, subsequently amended as to field limits.

On December 3, 1958, Vicon, Inc. requested the Commission to issue an emergency order which would grant permission to drill a well off the established spacing pattern.

FINDINGS

The Commission finds as follows:

1.      That the Commission has jurisdiction to promulgate the hereinafter prescribed order.

2.      That an emergency exists which requires immediate action and a modification of existing orders in the Orchard Field, insofar as they pertain to the drilling of a well in the center of the SE¼ NW¼ of Section 10, Township 4 North, Range 60 West, 6th P.M.; and that an emergency order should be issued in accordance with the provisions of 100-6-7(3) of the Colorado Oil and Gas Conservation Act, for the drilling of a well in the center of the NW ten acres of said drilling unit.

3.      That Applicant states that it is indicated by various geological data that the center of the Northwest Quarter of the Southeast Quarter of the Northwest Quarter (C-NW¼ SE¼ NW¼) of Section Ten (10), Township Four (4) North, Range Sixty (60) West, 6th P.M., Morgan County, Colorado, would be the proper location in which to drill a test well.

4.      That the Commission has contacted all lease owners of offset contiguous drilling units, and found no objection to the drilling of a well at the location described in Finding 3 above.

ORDER

NOW, THEREFORE, IT IS ORDERED, that an exception is hereby granted for a well to be drilled in the center of the Northwest Quarter of the Southeast Quarter of the Northwest Quarter (C NW¼ SE¼ NW¼) of Section Ten (10), Township Four (4) North, Range Sixty (60) West, 6th P.M., Morgan County, Colorado, and that said well shall be the permitted oil of gas well for the drilling and spacing unit upon which it is located.

IT IS FURTHER ORDERED, that this order shall be effective fifteen (15) days; commencing December 3, 1958.
