ORDER NO. 308-1

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on May 18, 1976 at 9 a.m. in Room 532, State Services Building, Denver, Colorado, after giving Notice of Hearing as required by law, on the petition of Dwight L. Hamilton and Gladys D. Hamilton, requesting an order prohibiting waste from occurring in the Harrisburg Field by the present production practices of the operator.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That it was not proven by a preponderance of the evidence presented at the hearing that waste is occurring at this time.  Therefore, no action should be taken concerning the production practices in the Harrisburg Field.  However, in order to monitor the water influx in the reservoir, production tests should be taken monthly of Well No. 4 Johnson, located in the NE¼NW¼ Section 4, Township 3 South, Range 52 West, 6th P.M., until such time as the Director determines such tests are no longer necessary.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that no action shall be taken at this time concerning the production practices in the Harrisburg Field, Washington County, Colorado.

 

IT IS FURTHER ORDERED, that production tests shall be taken monthly on Well No. 4 Johnson, located in the NE¼NW¼ Section 4, Township 3 South, Range 52 West, 6th P.M., until such time as the Director determines such tests are no longer necessary and shall be as follows:

 

Rule 1.    Production tests shall be taken during any 24-hour period between the fifteenth (15th) and twentieth (20th) of each month, the results of which shall be reported to the Commission on or before the 25th day of the month on OGCC Form 9. Such tests shall be taken in accordance with good engineering principals and practices.

 

Rule 2.    The Commission and Dwight L. Hamilton shall be notified five (5) days prior to the testing of the well in order that they will have an opportunity to witness such tests.

 

IT IS FURTHER ORDERED, that these orders shall become effective July 1, 1976.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
