ORDER NO. 217-1

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on July 15, 1969, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing and proper service thereof, on the application of Knute Overn for an order granting an exception to Rule 316 of the Rules and Regulations of the Oil and Gas Conservation Commission of the State of Colorado.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That testimony presented at the hearing indicates that the requirement to drill a new well at a location as authorized by said Rule 316 would create a hardship on the applicant and that in order to prevent waste and protect the correlative rights of all parties concerned, an exception to said Rule 316 should be granted for the applicant to re-enter a plugged and abandoned well located 200 feet South of the North line and 200 feet West of the East line of Lot 5, Section 12, Township 4 North, Range 99 West, 6th P.M., Moffat County, Colorado, and attempt to complete same as an oil well in the Weber formation and to test certain other zones up the hole for potential production of oil and/or gas; however, should commercial production be encountered in the re-entry of said well, the Commission should, at the request of interested persons, take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the location of the well as an exception.

 

ORDER

NOW, THEREFORE, IT IS ORDERED, that an exception to Rule 316 of the Rules and Regulations of the Oil and Gas Conservation Commission of the State of Colorado is hereby granted for the re-entry of a plugged and abandoned well located 200 feet South of the North line and 200 feet West of the East line of Lot 5, Section 12, Township 4 North, Range 99 West, 6th P.M., Moffat County, Colorado; however, if commercial production is encountered in said well, the Commission shall, at the request of interested persons, take such action as will offset any advantage which the person securing the exception may have over other producers by reason of the location of the well as an exception.
