CAUSE NO. 115

ORDER NO. 115-4

REPORT OF THE COMMISSION

This cause came on for hearing before the Commission on June 23, 1959, at 10 a.m., in the Game Room of the Albany Hotel, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of the Ancora Corporation for an order designating the SW¼ of Section 13 and the NW¼ of Section 24, Township 4 North, Range 58 West, Morgan County, Colorado, as a drilling and spacing unit to be included in the Young Field; and for a further order authorizing the drilling of a test well to be located in the C NW¼ NW¼ NW¼ of Section 24 of said township and range.  At the hearing, Applicant withdrew the request for a well to be located at the above location.

FINDINGS

The Commission finds as follows:

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

3.      That on January 28, 1958, the Commission issued its Order No. 115-1, which, among other things, defined the area and established 320-acre drilling and spacing units for the production of gas from the "D" sand formation underlying the Young Field, which order was subsequently amended by Order No. 115-2, redefining said Young Field and describing the drilling and spacing units for said field.

4.      That subsequent information and testimony presented at the hearing reveals that the "D" sand formation of the Young Field constitutes a common source of supply of oil and gas underlying, in addition to the area set forth in said Order No. 115-2, the following described lands in Morgan County, Colorado, to-wit:

Township 4 North, Range 58 West, 6th P.M.

Section 13:  SW¼

Section 24:  NW¼

and that such area should be subject to the provisions of Order No. 115-1, and established as an additional drilling and spacing unit for the production of gas from the "D" sand formation underlying said area.

ORDER

NOW, THEREFORE, IT IS ORDERED, that the Southwest Quarter (SW¼) of Section Thirteen (13) and the Northwest Quarter (NW¼) of Section Twenty-four (24), Township Four (4) North, Range Fifty-eight (58) West, 6th P.M., Morgan County, Colorado, shall be included in the Young Field and be subject to the provisions of Order No. 115-1, and such area is hereby established as a drilling and spacing unit for the production of gas from the "D" sand formation underlying said area; and henceforth the Young Field shall include the following described lands in Morgan County, Colorado, to-wit:

East Half (E½) of Section Ten (10), Section Eleven (11), West Half (W½) of Section Twelve (12), Southwest Quarter (SW¼) of Section Thirteen (13), Section Fourteen (14), East Half (E½) of Section Fifteen (15), North Half (N½) of Section Twenty-three (23), and Northwest Quarter (NW¼) of Section Twenty-four (24), Township Four (4) North, Range Fifty-eight (58) West of the 6th P.M.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend, or repeal any and/or all of the above order.

ORDERED this 23rd day of June, 1959.
