ORDER NO. 105-4

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on November 7, 1961, at 10 a.m., in Room 132, State Services Building, Denver, Colorado, after publication of Notice of Hearing as required by law, on the application of the Frankfort Oil Company for an order (a) extending the boundaries of the McClave Field; (b) establishing seven drilling and spacing units of approximately 640 acres each; and (c) providing that no more than one gas well be drilled to or produced from the McClave Sand on such units.

 

FINDINGS

 

The Commission finds as follows:

 

1.      That due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

2.      That the Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

3.      That the McClave Sand constitutes a common source of supply of gas underlying, in addition to the area set forth in Order No. 105-2, the following described lands in Bent County: Colorado, to-wit:

 

Township 21 South, Range 48 West, 6th P.M.

 

 

Section 1:  S½

Section 3:  S½

Section 2:  S½

Section 4:  S½

Section 5:  Lots 1 through 10, inclusive, and S½

Section 6:  Lots 1 through 15, inclusive, and E½SW¼, SE¼

Section 8:  All

Section 9:  All

 

and that such area should be subject to the provisions of Orders No, 105-1 and No. 105-2.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that the following rules and regulations shall apply hereafter to a well drilled, completed or recompleted in the McClave Sand underlying the McClave Field, herein defined, in addition to other applicable rules and regulations and orders of the Commission, if any, heretofore adopted and not in conflict herewith:

 

Rule 1.    The McClave Field shall henceforth include the following described lands in Bent and Kiowa Counties, Colorado, to-wit:

 

Township 19 South, Range 48 West, 6th P.M.

Kiowa County, Colorado

 

Sections 31, 32, 33, 34, 35 and 36

 

Township 20 South, Range 48 West, 6th P.M.

Kiowa County, Colorado

 

Sections 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29.30, 31, 32, 33, 34, 35 and 36

Rule 2.    The following drilling and spacing units consisting of approximately 640 acres are hereby established for the production of gas from the McClave Sand, common source of supply underlying the lands set forth in Finding 3 hereof:

Lots 14 and 15, E½SW¼, SE¼

 

 

 

and the permitted well for each such unit shall be located not less than 990 feet from the boundary lines thereof;

and the permitted well for each, such unit shall be located within a radius of 990 feet from the center of each such unit.

 

IT IS FURTHER ORDERED, that the rules and regulations contained herein shall become effective forthwith, and henceforth the commencement of the drilling of any well or wells in the McClave Sand, common source of supply in the McClave Field, as defined herein, for the purpose of producing gas therefrom, at a location other than authorized by this order, is hereby prohibited.

 

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend, or repeal any and/or all of the above orders, rules and regulations.
