ORDER NO. 105-28

 

REPORT OF THE COMMISSION

 

This cause came on for hearing before the Commission on July 16, 1984 at 9:00 a.m., in Room 110, State Centennial Building, Denver, Colorado, after giving Notice of Hearing as required by law, on two (2) applications of Planet Associates, Inc. for an order granting exceptions to the permitted well locations as provided for in the orders of Cause No. 105 and allow a well to be drilled at a location 1980 feet from the west line and 660 feet from the south line of Section 23, Township 20 South, Range 48 West, 6th P.M., and a well to be drilled at a location 1980 feet from the west line and 660 feet from the south line of Section 7, Township 20 South, Range 48 West, 6th P.M., and that each be the permitted well for the unit upon which it is located.

 

FINDINGS

 

The Commission finds as follows:

 

1.      Planet Associates, Inc., as applicant herein, is an interested party in the subject matter of the above-referenced hearing.

 

2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

 

3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

 

4.      On May 15, 1957, the Commission issued Order No. 105-1 which established 640-acre drilling and spacing units for the production of gas from the McClave Sand underlying certain lands in Bent and Kiowa Counties, Colorado.  The order was amended by Order No. 105-2 which provided for the permitted well to be located within a radius of 990 feet from the center of the drilling and spacing unit, with exception for topographical reasons.  Subsequent orders extended the limits of the field.

 

5.      Based upon the facts stated in the applications, the Commission should, according to 34-60-108(7) C.R.S. 1973, as amended, grant the exceptions as requested.

 

6.      No objections to the application were received.

 

ORDER

 

NOW, THEREFORE, IT IS ORDERED, that an exception to the permitted well location, as provided for in the orders in Cause No. 105 for the McClave Field, Kiowa County, Colorado, is hereby granted for a well to be drilled at a location 1980 feet from the west line and 660 feet from the south line Section 7, Township 20 South, Range 48 West, 6th P.M. and a well to be drilled at a location 1980 feet from the west line and 660 feet from the south line Section 23, Township 20 South, Range 48 West, 6th P.M., and that each shall be considered the permitted well for the unit upon which each is located.

 

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective, forthwith.
