REPORT OF THE COMMISSION

This cause came on for hearing before the Oil and Gas Conservation Commission on March 20, 1989 at 8:30 a.m. in Room 101, State Education Building, 201 East Colfax, Denver, Colorado after giving Notice of Hearing as required by law, on the request of Donald R. Kennedy, Pat Greer and James R. Greer to be exempt from the bonding requirements a provided for in Rule 304 for the well Kennedy No. 1 located in the NW¼ NE¼, Section 17, Township 33 North, Range 12 West, N.M.P.M., La Plata County Colorado.

FINDINGS

The Commission finds as follows:

            1.      Donald R. Kennedy, Pat Greer and James R. Greer, as applicants, are interested parties in the subject matter of the above referenced hearing.

            2.      Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

            3.      The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

            4.      The gas from said well, of extremely low volume, is to be used for domestic purposes on the Kennedy property.

            5.      Donald R. Kennedy, Pat Greer and James R. Greer, as owners of the well, should assume full liability relative to the production of gas from said wells as well as the responsibilities t properly plug and abandon the wells at such time as production is no longer available.

            6.      Security in the sum of not less than One thousand ($1,000.00) dollars should be posted with the oil and Gas Conservation Commission.

            7.      Donald R. Kennedy, Pat Greer and James R. Greer should record this order with the Clerk and Recorder of La Plata County, Colorado.

ORDER

NOW, THEREFORE IT IS ORDERED, that Donald R. Kennedy, Pat Greer and James R. Greer shall post security with the Oil and Gas Conservation Commission in the sum of not less than one thousand ($1,000.00) dollars for operation of well Kennedy No. 1 located in the NW¼ NE¼, Section 17, Township 33 North, Range 12 West, N.M.P.M., La Plata County, Colorado.

IT IS FURTHER ORDERED, that Donald R. Kennedy, Pat Greer and James R. Greer shall assume full liability relating to the production of gas from said wells and the responsibility to properly plug and abandon said well at such time as production is no longer available in accord with Rule 320.

IT IS FURTHER ORDERED, that Donald R. Kennedy, Pat Greer and James R. Greer shall record this order with the Clerk and Recorder of La Plata County, Colorado.

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
