REPORT OF THE COMMISSION

This cause came on for hearing before the Oil and Gas Conservation Commission on March 20, 1989 at 8:30 a.m. in Room 101, State Education Building, 201 East Colfax, Denver, Colorado after giving Notice of Hearing as required by law, on the request of James K. Hutton and Thelma G. Hutton to be exempt from the bonding requirements as provided for in Rule 304 for the wells Hutton #1-1 located in the NE¼ SW¼ Section 1 and the Hutton 01-35 located in the NE¼ SW¼ Section 35, Township 5 South, Range 43 West, 6th P.M., Yuma County, Colorado.

FINDINGS

The Commission finds as follows:

1.   James K. Hutton and Thelma G. Hutton, as applicants, are interested parties in the subject matter of the above reference hearing.

2.   Due notice of the time, place and purpose of the hearing has been given in all respects as required by law.

3.   The Commission has jurisdiction over the subject matter embraced in said Notice, and of the parties interested therein, and jurisdiction to promulgate the hereinafter prescribed order.

4.   The gas from said wells, of extremely low volume, is to be used for domestic purposes on the Hutton property.

5.   The Huttons, as owners of the wells, should assume full liability relative to the production of gas from said wells as well as the responsibilities to properly plug and abandon the wells at such time as production is no longer available.

6.   Security in the sum of not less than one thousand ($1,000.00) dollars per well should be posted with the Oil and Gas Conservation Commission.

7.   The Huttons should record this order with the Clerk and Recorder of Yuma County, Colorado.


 

O R D E R

NOW, THEREFORE IT IS ORDERED, that James K. Hutton and Thelma G. Hutton shall post security with the Oil and Gas Conservation Commission in the sum of not less than one thousand ($1,000.00) dollars per well for operation of well Hutton #I-l located in the NE1/4 SW1/4 Section 1 and Well #1-35 located in the NE¼ SW¼ Section 35, Township 5 South Range 43 West, 6th P.M., Yuma County, Colorado.

The production of gas from said wells and the responsibility to properly plug and abandon said wells at such time production is no longer available in accord with Rule 320.

IT IS FURTHER ORDERED, that the Huttons shall record this order with the Clerk and Recorder of Yuma County, Colorado.

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.

IT IS FURTHER ORDERED, that the Commission expressly reserves its right, after notice and hearing, to alter, amend or repeal any and/or all of the above orders.
