Authorizes the Director to approve all pits designed and located in accordance with the Commission's regulations; or where the pit is not lined, but the applicant supplies evidence that the quality of produced water is equivalent of the underlying aquifer; or where it is clearly established by evidence or percolation tests that seepage will not reach the underlying aquifer or waters of the State. If applicant is not able to comply with the above, he may submit a complete economic statement of the situation, including estimates of lining the pit or methods protecting the pit from seepage, and estimates as to the production and reserves which may be lost in primary and secondary recovery to the Director, who will then submit it to the Commission. If applicant believes the first paragraph above will prevent use of produced water, which he feels is usable for stock or irrigation purposes, he may submit test results and materials substantiating such need, and a proposed plan showing how it can be accomplished. If the Director feels that produced water from a field, fields or combination of wells could be disposed of underground, he shall notify the Commission and operators in the affected areas of such recommendation. Operators shall have one hundred twenty (120) days to submit a plan for underground disposal. Any other application, not requiring action under the above paragraph, will be submitted to the Commission with the Director's recommendation for final action.
