NOTICE OF HEARING ON BRADENHEAD MONITORING AREA

TO ALL INTERESTED PARTIES AND TO WHOM IT MAY CONCERN:

Rule 207.b. of the Rules and Regulations of the Colorado Oil and Gas Conservation Commission give the Director the authority to designate specific fields or portions of fields as bradenhead test areas within which, on any well, the bradenhead access to the annulus between the production and surface casing, as well as any intermediate casing, shall be equipped with fittings to allow safe and convenient determinations of pressure and fluid flow. Any such proposed designation shall occur by notice describing the proposed bradenhead test area.

The following bradenhead testing and reporting requirements are proposed for the Mamm Creek Field:

By November 1, 2004, bradenhead monitoring shall be performed on all wells in the Mamm Creek Field. The Mamm Creek Field Area is defined as follows:

Township 6 South, Ranges 91-93 West, 6th P.M.

Township 7 South, Ranges 91-93 West, 6th P.M.

Township 8 South, Ranges 91-93 West, 6th P.M.

Township 9 South, Ranges 91-93 West, 6th P.M.

Upon completion of any well, and on wells presently completed, the operator shall equip the bradenhead access to the annulus between the production and surface casing, as well as any intermediate casing, to above ground level with approved fittings to allow safe and convenient determination of pressure and fluid flow. This rule shall apply to all wells in the field. The operator shall test all wells for pressure and flow on an annual basis, with results submitted to OGCC no later than November 1 of each calendar year. Operators shall notify COGCC staff a minimum of ten (10) days prior to monitoring to allow staff to witness testing on a random basis. Remedial requirements and additional subsequent monitoring will be determined based on the results of the annual tests.

The test shall be performed by verifying the tubing and casing pressures and flow characteristics of the well. A pressure gauge with a range of one thousand (1000) psig shall be used to measure the bradenhead (surface and intermediate casing) pressure(s).

The results of the annual bradenhead test for pressure and flow for each well shall be provided to the COGCC Northwest Area Engineer electronically in the form of an Excel Spreadsheet containing the information and format as shown in the attached example.

If bradenhead pressures greater than one hundred fifty (150) psig are observed or a continuous flow of liquid at any pressure, such conditions and pressures shall be immediately reported to the COGCC Northwest Area Engineer. A Bradenhead Test Report, Form 17 and a Sundry Notice, Form 4 containing the bradenhead monitoring results and proposed remediation procedure shall be submitted electronically to the COGCC Northwest Area Engineer within seven (7) days of the report.

NOTICE IS HEREBY GIVEN, that the Oil and Gas Conservation Commission of the State of Colorado, pursuant to the above, has scheduled the above-entitled matter for hearing on:

Pursuant to said hearing in the above-entitled matter at the time and place aforesaid, or at any adjourned meeting, the Commission will enter such orders as it deems appropriate to protect the health, safety and welfare of the public and to prevent the waste of oil and gas, either or both, in the operations of said field, and to carry out the purposes of the statute.

In accordance with Rule 509., any interested party desiring to protest the granting of the application or to intervene on the application should file with the Commission a written protest or intervention no later than September 3, 2004, briefly stating the basis of the protest or intervention. Such interested party shall, at the same time, serve a copy of the protest or intervention to the person filing the application. An original and nine (9) copies shall be filed with the Commission (Rule 503.f.). Anyone who files a protest or intervention must be available to participate in a prehearing conference during the week of September 6, 2004. Pursuant to Rule 503.e., if a party who has received notice under Rule 503.b. wishes to receive further pleadings in the above-referenced matter, that party must file a protest or intervention in accordance with these rules. In accordance with the practices of the Commission, should no protests or interventions be filed in this matter by September 3 2004, the Applicant may request that an administrative hearing be scheduled for the week of September 6, 2004.
