ALL INTERESTED PARTIES AND TO WHOM IT MAY CONCERN:
On September 26, 2001, a Colorado
Oil and Gas Conservation Commission (“COGCC”) Form 2, Application for Permit-to-Drill
(“APD”) was approved for Petroleum Development Corporation (“PDC”) to drill the
Jeffers #41-35 Well located in the NE¼ NE¼ of Section 35, Township 4 North,
Range 68 West, 6th P.M. The APD for the
Jeffers #41-35 Well specified the objective formation as the “J” Sand. The APD was approved by the COGCC Director
only for this formation. On
On January 2, 2004, COGCC staff
issued an Administrative Order by Consent (“AOC”) to Petroleum Development
Corporation for the violation of COGCC Rule 303.b., Rule 301., and Section
34-60-117.(1) of the Oil and Gas Conservation Act for failure to have an
approved Application for Permit-to-Drill or Application for
Permit-to-Recomplete to the Codell Formation, not providing written notice of
intention to do work and failure to protect correlative rights of all owners in
every field or pool for the Jeffers #41-35 Well. On
