                       Comments:         Local Public Forum was held on April 5, 2000 in Durango.  Prehearing conference was held on April 12, 2000 in Denver.  On April 25, 2000 the Commission issued Order No. 112-156 which approved the downhole technical portion of this application.  Order No. 112-156 has been stayed pending the Public Issues Hearing.  Continued from the June 5 and 6 Public Issues Hearing.

Administrative Orders by Consent

 

                        Cause No. 1, Docket No. 0007-OV-07, Moffat County

 

                        STAFF RECOMMENDATION

 

                        Subject:                        Request to approve an Administrative Order by Consent finding Reed Operating Company, Inc. (“Reed”) in continuing violation of Rules 602.b. and 603.g., failure to remediate potentially dangerous conditions as soon as practical and that all locations shall be kept free of equipment, supplies, weeds and other waste material and Rules 317.f. and 317.g., failure to cement the casing in a manner sufficient to protect all fresh water for the Shefstead-Ninker #1 Well.  Further the AOC proposed that Reed clean up the location and protect the aquifer within thirty (30) days of the date the AOC is accepted by the Commission.  In addition, a monetary penalty of Two Thousand dollars ($2000) should be assessed.

 

                        Cause No. 1, Docket No. 0007-OV-08, Routt County

 

                        STAFF RECOMMENDATION

 

                        Subject:                        Request to approve an Administrative Order by Consent finding Dominion Energy Corporation (“Dominion”) in continuing violation of Rule 326.b., failure to perform a mechanical integrity test within two (2) years of the shut-in date for the State 1-36 Well, Further, the AOC proposed that Dominion either perform a mechanical integrity test, place on production, or plug and abandon the State 1-36 Well within sixty (60) days of the date the AOC is accepted.  In addition, a monetary penalty of One Thousand dollars ($1000) should be assessed.
