APPLICATION FOR IN-FILL DRILLING

Comes now Ellora LLC, Applicant, hereby petitions the Colorado Oil and Gas Conservation Commission, for an Order allowing in-fill drilling in a portion of the McClave Field, Bent County, Colorado, as set forth below, and as grounds therefore alleges as follows:

Applicant is the owner of, or has the right to acquire, Oil and Gas Leases covering the following described lands, to wit:

TOWNSHIP 21 SOUTH, RANGE 48 WEST, 6TH P.M.

Section 24: All

Bent County, Colorado

Hereinafter known as the "Subject Lands".

The Commission has jurisdiction over this matter and this application is filed pursuant to C.R.S Section 34-60-116(4).

By its Order No. 105-1 dated May 15, 1957 the Commission established 640-acre drilling and spacing units for the production of gas from the McClave Sand in the McClave Field. Further, the units were to consist of a governmental surveyed section. By its Order No.105-23 the Commission added to its Order No. 105-1 the McClave Sand underlying the Subject Lands in the McClave Field and under said Order the permitted well shall be at a location no closer than 990 feet to the boundaries of the unit.

Applicant believes that the existing well, the State G #1 Well located 1300’ FNL and 990’ FEL in the SENE of Section 24, Township 21 South, Range 48 West, 6th P.M., Bent County, Colorado, cannot drain the recoverable gas reserves underlying Subject Lands. Therefore, Applicant believes that an additional well is necessary to adequately produce all recoverable reserves under the Subject Lands.

To protect the correlative rights of the mineral and leasehold owners in Section 24, Township 21 South, Range 48 West, 6th P.M., Applicant desires to drill an additional productive well to be located on a legal location on the Subject Lands in accordance with Order 105-1.

By virtue of the Declaration of Pooling and Production dated July 27, 1979 the leasehold and mineral ownership has been pooled and no issues exist as to the leasehold or mineral ownership within the Subject Lands.

The names and addresses of the interested parties, as defined in Rule 507-a- (1) of the rules and regulations of the Colorado Oil and Gas Conservation Commission, according to the information ad belief of Applicant, are set forth in Exhibit "A" attached hereto and made a part hereof.

In accordance with the practices of the Commission, should no protests or interventions be filed in this matter by December 27, 2004, Applicant requests the Director of the Commission approve this Application. If the Director does not approve this application without hearing, then Applicant requests the Commission schedule an administrative hearing on this application.

WHEREFORE, Applicant respectfully requests the Oil and Gas Conservation Commission set this matter for hearing, that notice of said hearing be given as required by law, and following such hearing the Commission enter an order granting an amendment to Cause No. 105, allowing an additional productive well location to be located on a legal location on Subject Lands in accordance with Cause No. 105 Order No. 1.
