APPLICATION
COMES NOW Chevron U.S.A. Inc. ("Applicant"), a Pennsylvania corporation, by its attorneys, Gorsuch Kirgis LLP, and makes application to the Oil and Gas Conservation Commission of the State of Colorado for an order pooling certain interests for the production of oil and gas from the Fruitland Coal Seams in the Ignacio-Blanco Field, La Plata County, Colorado and in support of its application states and alleges as follows:

2. That Applicant owns a leasehold interest in all or a portion of the following described lands (hereinafter “Application Lands”):

3. That the Application Lands are subject to the Commission's Orders No. 112-60 and 112-61 which established 320 acre drilling and spacing units for the production of methane gas from the Fruitland coal seams underlying certain lands including the Application Lands and the Commission’s Order 112-156 which allows an optional additional well to be drilled upon the Application Lands for production of gas from the Fruitland coals seams.

One of Applicant’s predecessors-in-interest
drilled the University 9-1 well upon the Application Lands in July 1992. Such well has been producing from the
Fruitland coal seams since that time.
Effective

Since the acquisition by Texaco, representatives of Texaco and later by Applicant have been in contact with some of these unleased mineral owners in an attempt to arrange proper payment of proceeds as from the time Texaco acquired the well. These efforts, for various reasons, have not been successful in all cases. It is therefore appropriate for Applicant to request force pooling of certain unleased mineral owners under the applicable provisions of C.R.S. Section 34-60-116 and the rules of the Commission. Applicant requests that force pooling become effective as of the effective date of the Commission’s order.
6. That the names and addresses of the interested parties according to the information and belief of the Applicant are set forth in Exhibit A attached hereto and made a part hereof. Those interested parties which Applicant seeks to force pool as of the effective date of the Commission’s order are those whose names are capitalized.
WHEREFORE, Applicant respectfully requests that this matter be set for hearing in July, 2004, that notice be given as required by law and that upon such hearing this Commission enter its order consistent with Applicant's request as set forth above.
