APPLICATION
COMES
NOW, Ensign Operating Co., a Delaware corporation, by its attorneys Dorsey
& Whitney LLP and makes application to the Oil and Gas Conservation
Commission of the State of Colorado, for an order allowing an exception to the
location of a well to be completed in an existing drilling and spacing unit for
the Wasatch and Fort Union-Lance-Lewis Formations, Hiawatha West Field, Moffat
County, Colorado. In support thereof,
Ensign Operating Co. (“Applicant”) states and alleges as follows:

That the Applicant is the owner of leasehold interests
in Moffat County, Colorado, located within the area requested for an exception
location in an existing spacing unit.
2.
That in accord with Order No. 133-22, the lands covered
by this Application have been spaced for production of gas from the Wasatch and
Fort Union-Lance-Lewis Formations with up to 8 wells being permitted for each
320-acre unit with wells being located no closer than 600’ from the outer
boundary of such units. The lands
subject to this Application are:
Township 12 North, Range 101 West, 6th P.M.
Section 26: S/2

Due to topographical conditions, Applicant proposes to
drill the Lion Government #14-26 Well at a proposed exception location 448’ FSL
and 1187’ FWL of Section 26, T12N, R101W.

That previous Orders have recognized the rough
topography in this area, that the land is very dry with sparse vegetation and
that no population is present.
5.
That in order to prevent waste and protect correlative
rights of all owners in the area surrounding the proposed location, it is
reasonable and equitable to permit an exception location to allow the
recompletion of a well in the described location. Applicant also asserts that Rule 318 c of the
Rules and Regulations of the Oil and Gas Conservation Commission provides for
exception locations when geologic, topographical or environmental conditions
warrant a variance from field rules.

That all contiguous and cornering Owners in lands toward
when the well is proposed to be moved who are affected by the exception
location are set forth on Exhibit A attached hereto. WHEREFORE,
Applicant respectfully requests that this matter be set for hearing at the next
regular hearing date, that notice thereof be given as required by law and that
upon such hearing the Commission enter its order:
A. Determining
that the Lion Government #14-26 Well located in the S/2 of Section 26, T12N,
R101W be permitted to be drilled into the Wasatch and Ft. Union-Lance-Lewis
Formations as follows:
