APPLICATION

COMES NOW Williams Production RMT Company ("Applicant"), a Delaware corporation, by its attorneys, Gorsuch Kirgis LLP, and makes application to the Oil and Gas Conservation Commission of the State of Colorado for an order establishing spacing rules applicable to the drilling and producing of wells from the Williams Fork Formation of the Mesaverde Group covering certain described lands in the Parachute Field area, Garfield County, Colorado and in support of its application states and alleges as follows:

1.                  That Applicant is a corporation duly authorized to conduct business in the State of Colorado.

2.                  That Applicant owns a leasehold interest in the following described lands:

Township 7 South, Range 95 West, 6th P.M.

Section 6:  N/2

 

(hereinafter the “Subject Lands”)

 

3.                  That the Subject Lands are subject to the Commission's Order No. 440-12 which established 320-acre drilling and spacing units for the Mesaverde Formation covering certain described lands including the Subject Lands.  However, such order also provided that the GV 42-6 well located on the SW/4NE/4 of the Subject Lands would continue to be treated as a well pooled upon a 160 acre basis since the well had been spudded prior to the date of the order.  Two additional wells have been drilled in the NE/4 of the Subject Lands, the PA 41‑6 well (Williams Fork) drilled in NE/4NE/4 and the TW 11‑6 (Wasatch) drilled in SW/4NE/4.  Both of those wells also were drilled and produced under pooling agreements covering only the NE/4 of the Subject Lands.

4.                  Plans are now underway to drill wells upon the NW/4 of the Subject Lands (as well as additional wells on the NE/4 of the Subject Lands) and it is appropriate that the 320 acre drilling and spacing unit established for the Subject Lands be vacated in favor of two 160 acre drilling and spacing units for the Williams Fork Formation of the Mesaverde Group, one being the NE/4 of the Subject Lands and the other being the NW/4 of the Subject Lands.  No prejudice will result by changing from one 320 acre drilling and spacing unit to two 160 acre drilling and spacing units since the only wells located on the 320 acre unit are being produced on a pooled 160 acre basis.

5.                  That the above-proposed spacing and well location rules will allow more efficient drainage of the Williams Fork Formation of the Mesaverde Group; will not promote waste; will not violate correlative rights and will assure the greatest ultimate recovery of gas and associated hydrocarbon substances from the reservoir.

6.                  That the names and addresses of the interested parties according to the information and belief of the Applicant are set forth in Exhibit A attached hereto and made a part hereof.

WHEREFORE, Applicant respectfully requests that this matter be set for hearing in April, 2004, that notice be given as required by law and that upon such hearing this Commission enter its order consistent with Applicant's proposals as set forth above.
